These terms are an agreement between you and RetailLeads (“we”, “us”) for Retaileads (the “Service”), at https://retaileads.com. By creating an account or making a payment, you agree to them. If you use the Service for a company, you agree to them on its behalf and confirm that you are authorized to.
1. The Service
Retaileads is a searchable database of US business listings, compiled from multiple public sources. With a free account you can search, filter and see counts and a masked preview of the results. The paid plans are described below.
2. Your account
- You must be at least 18 and able to enter into a contract.
- Give accurate information, keep your password secure, and tell us if you think your account has been compromised.
- An account is for one person. Do not share your login. You are responsible for what happens under your account.
3. Plans and payment
Payments are processed by Stripe. You are responsible for any taxes that apply.
Lifetime costs $399 once (USD). It gives you complete contact details for every business in the dashboard and unlimited CSV exports, for as long as we operate the Service, including the data updates we publish in that time. If we ever discontinue the Service, we will give you at least 30 days’ notice so you can export what you need.
Monthly costs $59/month USD, billed in advance every month until you cancel. You can browse every page of results with contact details masked. Exporting a business unlocks its details for you for good. Each business counts once, the first time you export it, against an allowance of 150,000 businesses per billing month; exporting it again later is free. Unused allowance does not carry over. When the month’s allowance runs out, exports still include businesses you have exported before, and new ones wait for your next billing month. You can cancel anytime under Settings → Billing; you keep access until the end of the month you have paid for, and the plan does not renew. If a renewal payment fails, we may suspend the plan until it is paid.
Prices may change. A price change never affects a Lifetime purchase you have made; for Monthly, we will tell you at least 30 days before a new price applies to your renewals.
4. Refunds
A Lifetime purchase is fully refundable until you export any results; after your first export it is final. Monthly payments are not refunded, but you can cancel anytime. The details are in our Refund Policy, which is part of these terms.
5. What you may do with the data
We give you a non-exclusive, non-transferable license to use the data you view or export from the Service for the internal business purposes of you and your company, such as finding, researching and contacting prospective customers. You may import exports into your own CRM, email and sales tools, and share them with people in your own organization.
You may not:
- sell, resell, license, publish or give away the data or your exports as a list or database, in whole or in substantial part;
- use the data to build or supply a competing directory, lead-list or data product;
- share your account, or your exports, with people outside your organization;
- scrape or crawl the Service, access it by automated means other than the export feature, or try to get around its limits or the masking of the free preview.
The underlying listings are open data published under licenses such as the Community Data License Agreement – Permissive 2.0, Apache 2.0 and CC0 1.0 (see Sources & licenses). These terms govern the Service and the compiled exports we produce. They do not limit rights you have under those licenses for data you obtain from its original sources.
6. Using the data lawfully
You are responsible for how you contact the businesses in the Service. In particular you must:
- follow the CAN-SPAM Act for commercial email, including honest headers and subject lines, a physical postal address and a working opt-out (see our compliance guide);
- follow the Telephone Consumer Protection Act and the Telemarketing Sales Rule for calls and text messages. Many listed numbers are mobile phones, and autodialed or prerecorded calls and texts to them generally need prior consent;
- follow state laws, and the laws of any other country you contact businesses from or in;
- honor every opt-out and removal request you receive.
Do not use the Service for spam, harassment, fraud or any unlawful purpose. We are not a consumer reporting agency: do not use the data to make decisions about anyone’s eligibility for credit, insurance, employment, housing or any other purpose covered by the Fair Credit Reporting Act.
7. Accuracy of the data
The listings come from third-party open data. We clean and organize them, but we do not verify each one, and contact details can be incomplete, out of date or wrong. Counts can change as we publish data updates. Run email lists through a verification service before you send to them.
8. Fair use and limits
Each export holds up to 500,000 rows, in CSV files of up to 100,000 rows each, and you can run one export at a time. The Monthly plan’s allowance is described in section 3. Export files are kept for 30 days, after which you can rebuild them from the dashboard. We may limit the rate of requests, and may change these limits to keep the Service working for everyone.
9. Suspension and termination
You can delete your account at any time under Settings. We may suspend or close an account that breaks these terms, for example by reselling data, sharing an account or scraping the Service. If we close your account because you broke these terms, you are not entitled to a refund.
10. Our property
The Service, including its software, design, and the way we compile, clean and organize the data, belongs to us. The underlying listings belong to their sources and are used under their open-data licenses.
11. Disclaimers
The Service and the data are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise any particular results from your use of the data.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
13. Indemnity
You will defend and indemnify us against claims arising from your use of the data, including your outreach to businesses, or from your breach of these terms.
14. Changes to these terms
We may update these terms. For a material change, we will tell you by email or in the Service at least 14 days before it takes effect. If you keep using the Service after that, the new terms apply.
15. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and both of us consent to their jurisdiction.
